This section provides details about the technology in use with Electronic Liens and Titles (ELT). The goal is to provide a basis for states new to ELT to consider best practices for their state. What is included here
- Allowed and Required Which states offer an ELT program.
- Legislation The legislation passed in each state to alter laws affecting an ELT program.
- Title Holding States Who Holds the Title When There’s a Lien on a Vehicle?
Collateral Acceptability Issues
DDI has received opinions from the Federal Reserve and the FDIC that electronic titles meet standards for collateral basis. The state auditor should also provide an opinion.
Agreements with Lenders
The titling agency will need to develop an application form for lenders to apply to the state. DDI recommends that this application (and any agreement such as a Memorandum of Understanding) be kept as simple as possible. For examples of the forms and the application process required by each state, see http://www.etitlelien.com/enroll.
